Overtime and Your Job

What is overtime? In simple words, overtime is the amount of time that an individual works beyond the normal working hours. Almost all the countries of the world have overtime laws designed to deter or avert employers from forcing their employees to work for markedly long duration. Overtime laws, policies governing overtime and hours of work differ greatly from country to country and between dissimilar economic sectors.

In U.S., the Fair Labor Standards Act of 1937 applies to al the employees engaged in either producing goods or interstate commerce. The FLSA has established standard working week of 40 hours each. It says that overtime payment must be made to those people who work overtime and should be one and one-half times the workers' normal rate of pay for any time worked above 40 hours.

People who are exempted from the regulation include certain types of administrative, professional, and executive employees. For qualifying as an administrative professional, or executive employee and therefore not be entitled to overtime, three tests must be passed based on salary basis, duties, and salary level. These tests are different for all the levels viz administrative, professional and executive level. Employees cannot waive their FLSA protections and cannot abridge them by contract.

Even though overtime has been a concept in all industries since 1938, Las Vegas was slow to adapt to the benefits of working overtime. It was not until the construction phase of Mandalay Bay that overtime was introduced to the Las Vegas market. Some employers make the employees work for long hours without paying them extra; not paying overtime for time spent working while traveling; failing to pay overtime for attendance at training, meetings and lectures; failing to compensate for arriving early to perform necessary preparations for work. Such practices should be condemned and you should raise your voice if you are a victim of this!
